Rental Conditions

These Rental Conditions set out the general terms on which vehicles are rented from AfiCar Araç Kiralama ve Turizm Sanayi Ticaret Limited Şirketi ("AfiCar"). AfiCar is the car rental company of the Afinitem group. Reservation requests submitted through this website (aficar.net, the "Site") are subject to these conditions, which form an integral part of the Vehicle Rental Agreement signed at handover. The person submitting the reservation request and taking delivery of the vehicle (the "Renter") declares that they have read and accepted these conditions.

1. General Provisions

• The minimum rental period is 1 day (24 hours). The rental period is calculated in 24-hour days from the handover time.
• All prices are in Turkish Lira (TL) and include VAT.
• Prices shown on the Site are indicative; the final amount is communicated when AfiCar confirms the reservation request.
• Vehicles may be used only within the borders of the Republic of Türkiye, in compliance with traffic legislation and these conditions.

2. Driver Requirements

The Renter and any additional driver must meet the following minimum age and licence seniority requirements for the rented vehicle class:

• Young driver: Drivers aged 21–24 may rent Economy class vehicles only, and a young driver surcharge of 400 TL per day applies. In other classes, no rental is made below the minimum age.
• The vehicle may be driven only by the driver(s) named in the agreement. The same documents and driver requirements apply to any additional driver.

3. Required Documents

• Turkish ID card or passport (passport for foreign nationals).
• A valid new-type (card) driving licence; old-type licences are no longer valid as of 31 October 2025. Foreign drivers must present an international driving permit or a notarised Turkish translation of their national driving licence.
• A valid credit card in the driver's name with sufficient limit for the security deposit. Debit cards, prepaid cards and cards belonging to third parties are not accepted.
• Copies of the ID and driving licence are collected at vehicle handover, not through the Site.

4. Reservation, Payment, Cancellation and Changes

• A reservation request submitted through the Site becomes final only upon AfiCar's confirmation by email or phone, given after checking vehicle availability and driver requirements; no reservation exists before confirmation.
• Payment can be made in two ways: (a) by credit card at vehicle handover; (b) online during the reservation by credit or debit card through the iyzico payment infrastructure (3D Secure, instalments depending on the bank). With online payment, card details are not transmitted to or stored by AfiCar; the Renter accepts the Preliminary Information Form and the Distance Sales Contract. Reservations paid online become final upon completion of the payment. Cancellations and refunds are subject to the Cancellation and Refund Policy.
• Cancellations made up to 48 hours before the handover time are free of charge. For cancellations made less than 48 hours before the handover time, one day's rental fee is charged.
• If the Renter fails to collect the vehicle at the handover time without notice (no-show), one day's rental fee is charged and the reservation is deemed cancelled.
• Requests to change the dates, duration, delivery point or vehicle class are assessed subject to vehicle availability; the current price applies after the change.

5. Security Deposit (Pre-authorisation)

At handover, a pre-authorisation (hold) in the following amounts is placed on the credit card in the driver's name. The deposit is released when the vehicle is returned complete and undamaged; depending on the bank, it may take 7–15 business days for the amount to appear on the card.

Amounts relating to the rental period, such as damage, missing fuel, late return, HGS/OGS tolls, parking fees, traffic fines and cleaning fees, may be deducted from the deposit against supporting documents; amounts exceeding the deposit are charged to the Renter separately.

6. Delivery and Return

• Handover and return at our Esenler office take place Monday to Saturday between 09:00 and 19:00.
• Airport and address delivery/return is available 24/7 by appointment. A night delivery surcharge of 500 TL applies to handovers and returns between 22:00 and 07:00.
• At handover and return, the vehicle's damage condition, mileage and fuel level are recorded in a report together with the Renter. The Renter is liable for damage not recorded in the report and detected after return.
• Late return: A 1-hour grace period applies after the return time stated in the agreement. Beyond the grace period, one fifth (1/5) of the daily rental fee is charged for each commenced hour; if the delay exceeds 3 hours, a full day's rental fee is charged. Extension requests must be notified to and confirmed by AfiCar before the return time.

Delivery points and fees:

Fees are per direction. If the vehicle is returned at a point other than where it was collected, or at any point other than the office, the delivery fee of the return point is charged in addition.

7. Mileage and Fuel

• The mileage allowance is 500 km per day for daily rentals and 4,000 km per month for monthly rentals (30 days or more). An extra mileage package (+500 km) can be purchased at reservation; packages cannot be added after handover. The allowance is calculated over the total rental period.
• Mileage in excess of the allowance is charged at 5 TL per km.
• The vehicle must be returned with the same fuel level as at handover. Missing fuel is charged at the current market price plus a 500 TL service fee. No refund is made for excess fuel.
• Breakdowns and damage caused by misfuelling are excluded from all protection packages and are borne by the Renter.

8. Insurance and Protection Packages

All our vehicles are covered by compulsory third-party liability insurance and comprehensive (kasko) insurance. Under a standard rental, the Renter is liable, per damage event, for a damage excess equal to the deposit amount of the rented class; damage exceeding this amount is covered by the comprehensive insurance. Tyre, glass and headlight damage is excluded from standard cover unless the relevant protection is purchased.

Cases in which protection is void: In the following cases all protection packages are void, and the Renter is liable for all damage to the vehicle and to third parties, the vehicle's loss of value and the loss arising from the vehicle being unavailable for rental during repairs:

• Driving under the influence of alcohol or drugs,
• Use of the vehicle by a person without a driving licence or not named in the agreement (unauthorised driver),
• Damage caused intentionally,
• Use of the vehicle for unlawful purposes or for racing, speed testing, towing or pushing,
• Accidents occurring while the speed limit is being exceeded,
• Failure to obtain an accident report and an alcohol test report after an accident, or leaving the scene of the accident.

In the event of any accident, damage or theft, the Renter must immediately notify AfiCar (+90 530 849 14 14), not leave the vehicle at the scene, obtain an accident report (for damage-only accidents, a mutual accident report or a traffic police report) and an alcohol test report, and deliver these documents to AfiCar together with the other party's insurance details.

9. Extras and Additional Charges

Extras must be specified in the reservation request and confirmed by AfiCar; equipment extras are provided subject to availability.

10. Tolls (HGS/OGS), Parking and Traffic Fines

• Our vehicles are fitted with an HGS toll tag. Bridge, motorway and tunnel tolls and parking fees incurred during the rental period are charged to the Renter against the passage/usage record, plus a 10% service fee.
• Traffic fines incurred during the rental period are charged to the Renter at the exact fine amount (without a service fee) against the fine notice, or, as provided by law, the driver is notified to the authorities so that the fine is issued in the Renter's name. Penalty points and other administrative sanctions arising from fines rest with the driver.
• These items remain payable by the Renter even if notified after the end of the rental; they may be deducted from the deposit or charged separately.

11. Rules of Use

• Travel abroad: Taking the vehicle outside the borders of the Republic of Türkiye is prohibited.
• Smoking: Smoking and the use of tobacco products (including e-cigarettes) in the vehicle are prohibited; a cleaning fee of 1,500 TL is charged in case of breach.
• Pets: Pets may be carried only in a pet carrier and with prior notice at the time of reservation. Any resulting soiling or damage is borne by the Renter.
• The vehicle may not be used beyond its passenger or load capacity, to tow or push another vehicle, for driver training, racing or the carriage of passengers or goods for hire or reward; it may not be sub-rented or transferred to third parties.
• During the rental, the Renter must carry out the daily checks (oil, coolant, tyre pressure) with due care and immediately notify AfiCar of any warning light or breakdown.
• The vehicle's documents, keys and equipment (HGS tag, spare wheel, first aid kit, warning triangle, tool kit) must be returned complete; missing items are charged to the Renter.

12. Vehicle Tracking System

Our rental vehicles may be fitted with a vehicle tracking system (GPS). The system processes location data to ensure vehicle security, prevent theft and misuse, locate the vehicle in case of loss or accident, and monitor compliance with these conditions (ban on travel abroad, mileage allowance). By taking delivery of the vehicle, the Renter acknowledges being informed of this processing; details of how location data is processed are set out in the Privacy Notice (KVKK). Removing, disabling or tampering with the tracking system is prohibited.

13. Governing Law and Disputes

These conditions and the Vehicle Rental Agreement are governed by the laws of the Republic of Türkiye. The Courts and Enforcement Offices of İstanbul (Bakırköy) have jurisdiction over any disputes. For Renters who qualify as consumers, the provisions of the Consumer Protection Law No. 6502 on consumer arbitration committees and consumer courts are reserved. In case of conflict between these conditions and the Vehicle Rental Agreement, the Agreement prevails.
