Distance Sales Contract

This Distance Sales Contract (the "Contract") is concluded, pursuant to the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, between the Service Provider identified below and the Buyer who purchases a car rental service by paying online through the website (aficar.net, the "Site"), at the moment the Buyer ticks the acceptance box on the reservation form and completes the payment. Reservation-specific details (vehicle, period, delivery points, price) appear in the reservation summary and in the confirmation email sent to the Buyer and form an integral part of this Contract.

Buyer (Renter): The natural person who declares their name, Turkish ID / passport number, phone, email and billing address on the reservation form. The Buyer confirms that the information is accurate and up to date.

2. Subject

The subject of this Contract is the provision of the car rental service (the "Service") reserved electronically by the Buyer through the Site, whose characteristics and price are stated in the reservation summary, and the rights and obligations of the parties. The Service is subject to the AfiCar Rental Conditions, which are an annex to this Contract and apply together with the Vehicle Rental Agreement signed at handover.

3. Essential Characteristics of the Service

  • Vehicle class and sample model (in the reservation summary; AfiCar may allocate a vehicle of the same class "or similar"), transmission and fuel type.
  • Rental period: pick-up and return dates and times; the period is calculated in 24-hour days.
  • Delivery and return points (office, airport or address) and any delivery fee.
  • Included in the price: extended comprehensive insurance and compulsory traffic insurance, 500 km per day (4,000 km per month), HGS toll tag, 24/7 roadside assistance, VAT.
  • Selected extras (additional driver, child seat, Super CDW, Tyre-Glass-Headlight Protection, winter tyres, extra mileage package) and, where applicable, night delivery and young driver fees.

4. Price and Payment

  • The Service price is shown in Turkish Lira including VAT in the reservation summary. Payment is made by credit or debit card (3D Secure) through the payment infrastructure of iyzico Ödeme Hizmetleri A.Ş.; card details are not transmitted to or stored by AfiCar. Instalment options are offered on the payment screen depending on the bank.
  • The security deposit (pre-authorisation) is not included in the Service price; the amount stated per class in the Rental Conditions is blocked on the Renter's credit card at handover and released upon undamaged return.
  • Additional usage charges arising during the rental (excess mileage, missing fuel, late return, HGS tolls, traffic fines, etc.) are charged separately in accordance with the Rental Conditions.
  • The invoice is issued with the details declared by the Buyer and sent by email.

5. Performance and Delivery

  • The reservation becomes final upon successful payment; a reservation code and confirmation email are sent to the Buyer.
  • The vehicle is handed over at the date, time and location in the reservation summary to the Buyer, who must meet the driver requirements (age, licence duration) in the Rental Conditions and present a valid ID, driving licence and a credit card in their own name. If the requirements are not met, the Service cannot be performed and the "driver requirements not met" clause of the Cancellation and Refund Policy applies.
  • If AfiCar cannot provide a vehicle of the reserved class, it allocates a higher-class vehicle at the same price or, at the Buyer's choice, refunds the full amount paid.

6. Right of Withdrawal

Pursuant to Article 15(1)(g) of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for car rental services that must be performed on a specific date or within a specific period. Instead, the AfiCar Cancellation and Refund Policy applies in favour of the Buyer: cancellations made up to 48 hours before the handover time are refunded in full; for cancellations made less than 48 hours before, one day's rental fee is deducted and the remainder refunded. In case of a no-show, one day's rental fee is charged.

7. Cancellation, Changes and Refunds

  • Cancellation and change requests are submitted with the reservation code by phone, WhatsApp or email. Changes are subject to vehicle availability; any price difference is charged or refunded.
  • Refunds are made through iyzico to the card used for payment. AfiCar issues the refund instruction within 14 days at the latest; it may take 3–10 business days for the amount to appear on the card depending on the bank.

8. Obligations of the Parties

  • The Buyer must comply with the Rental Conditions, traffic legislation and the rules of use of the vehicle, and return the vehicle with the same fuel level and condition as at handover.
  • AfiCar must deliver the vehicle maintained, insured and in accordance with the reservation summary, and provide 24/7 roadside assistance.
  • If the Service is defective, the Buyer may exercise the optional rights arising from Law No. 6502.

9. Personal Data

Personal data processed during reservation and payment is processed under the Privacy Notice (KVKK). Data required for the payment (name, email, phone, ID number, billing address, transaction amount) is transferred to the payment institution iyzico; card data is processed solely by iyzico.

10. Disputes

Disputes arising from this Contract are resolved by the Consumer Arbitration Committees at the Buyer's place of residence or where the Service is provided, within the monetary limits set annually by the Ministry of Trade, and by the Consumer Courts for disputes above those limits. Turkish law applies.

11. Entry into Force

By ticking that they have read and accepted the Preliminary Information Form and this Contract on the reservation form and completing the payment, the Buyer accepts the Contract electronically. The Contract is sent to the Buyer's email address together with the reservation summary and retained by AfiCar for 3 years; the Buyer may request a copy at any time.
